The registration is taken based on a series of physical and natural investigations in different systems and can be varied in various countries. Here, the question is that the patent system is based on which process, and what can be the effects of the registration processes? Whether the patent is the same as the registration of other properties and whether can bring the same consequences or not? The study takes a descriptive-analytical method to investigate the differentiation aspects of the patent department from other properties. Besides, the study has analyzed the indicators of physical and natural patents and discriminate against the impacts. At last, the study concludes that the states determine the type of patent based on their policies. Today, making an effort to make trust in the results of the investigations of other countries can help the promotion of patent. Moreover, the nature of patent creates the right; although this is may not be true on registration of other properties. حق اختراع یک مخترع، از طریق ثبت اختراع ایجاد می‌شود. این ثبت در نظام‌های مختلف بر اساس یک سلسله از بررسی‌های شکلی و ماهوی صورت می‌گیرد که در کشورهای مختلف می‌تواند متنوع باشد. در اینجا این پرسش مطرح است که نظام ثبتی اختراعات مبتنی بر چه فرایندی است و آثار این فرایندهای ثبتی چه خواهد بود؟ آیا ثبت اختراعات مانند ثبت سایر اموال است و همان نتایج را خواهد داشت؟ مقاله با روش تحلیلی- توصیفی تلاش می‌کند به بررسی وجوه تمایز بخش ثبت اختراعات از سایر اموال و نیز مطالعة شاخصه‌های نظام‌های ثبتی شکلی و ماهوی بپردازد و آثار آن را تبیین کند و سرانجام نتیجه‌گیری می‌کند که کشورها بر اساس سیاست‌های خود نوع نظام ثبتی را تعیین می‌کنند و امروزه تلاش برای اعتمادسازی به نتایج جست‌وجوی دیگر کشورها می‌تواند به ارتقای نظام ثبتی کمک کند. افزون بر این، نفس ثبت اختراعات خود، موجد حق است درحالی‌که دربارة ثبت سایر اموال ممکن است چنین نباشد. https://jcl.illrc.ac.ir/article_239506_7ec9ca0b9ad63447b03fe85292653e45.pdf
