The present article attempted to reveal the secret of this stability by introducing the origins of this law and its domestic and external sources. The examination of civil law documents is possible through both case and general approaches. This article adopted a comprehensive and general approach based on the reliable reports of prominent civil law professors and the researcher's findings. The result showed that the main source in regulating the articles of civil law has been Imamiah jurisprudence from the inception and impact of the foreign law on the form and content is very slight and its content instances are controversial among experts. However, in the very content instances, an attempt was made to actively pass the civil law articles through the localization process. As a guiding principle in the interpretation of the provisions of civil law, this has always been of practical interest to jurists and judicial procedures.. قانون مدنی ایران با آن که در زمان حاکمیت طاغوت و در دوران سیطرة فرهتگ غرب بر نظام حاکم بر کشور به تصویب رسید؛ اما در بازنگری که از این قانون بعد از انقلاب و حاکمیت نظام اسلامی به عمل آمد تغییر چندانی متوجه آن نشد. مقالة حاضر در صدد است تا با معرفی ریشه‌های این قانون و منابع داخلی و خارجی آن، راز این ثبات را آشکار سازد. بررسی مستندات قانون مدنی با دو رویکرد موردی و کلی امکان پذیر است. رویکرد ما در مقاله حاضر رویکرد کلی و جامع بر اساس گزارش‌های قابل اعتماد استادان برجستة حقوق مدنی و یافته‌های نویسنده است. نتیجه بررسی‌های به عمل آمده آن است که منبع اصلی در تنظیم مواد قانون مدنی از همان ابتدا فقه امامیه بوده است و تاثر شکلی و محتوایی از حقوق خارجی بسیار اندک و مصادیق محتوایی آن نزد صاحب نظران، محل اختلاف است. با این وصف، در همان موارد محتوایی نیز تلاش شده است تا مواد قانون مدنی از فرآیند بومی‌سازی به گونه‌‍‌ای فعال عبور داده شود. این خصیصه به عنوان اصل راهنمای تفسیر در مواجهه با مواد قانون مدنی، همواره مورد توجه عملی حقوق‌دانان و رویه قضایی بوده است. https://jcl.illrc.ac.ir/article_239618_b97f035d8d91ece66959a6c395cfbb9c.pdf
