پژوهشکده حقوق و قانون ایران فصلنامه تحقیق و توسعه در حقوق تطبیقی 2981-1805 3 7 2020 06 21 Procedure for the Dispute Resolution Board on Civil Registration آیین دادرسی هیات حل اختلاف ثبت احوال 36 72 243178 10.22034/law.2021.520908.1005 FA امید توکلی کیا پژوهشگر پژوهشکده حقوق و قانون ایران (حقّا) 0000-0003-0810-8342 Journal Article 2020 05 21 At the headquarters of each civil registry office, a board called the "Dispute Resolution Board" has been formed to deal with the errors in the personal status documents and make a decision to fix them and deal with the correction, completion, change and cancellation of the personal status documents mentioned in Article 3 of the Civil Registration Act.The proceeding in the Board is conducted by submission of the application by the holders of the personal status documents or the beneficiaries or the registrars.The Dispute Resolution Board occupied a better position than other specialized administrative authorities in terms of observing the principles of a fair trial due to having a special procedure under the title of "Rules of Procedure of the Dispute Resolution Boards on Civil Registry" In this article, we will examine the organization, territorial and subject matter jurisdiction, the principles governing the proceeding in Dispute Resolution Board and its procedure. در مقر هر اداره ثبت احوال هیأت به نام « هیأت ‌حل ‌اختلاف» جهت رسیدگی به اشتباهات حادث‌‌شده در اسناد سجلی و تصمیم‌گیری برای رفع آنها تشکیل شده است و به تصحیح، تکمیل، تغییر و ابطال اسناد سجلی مذکور در ماده 3 قانون ثبت احوال رسیدگی می‌کند. رسیدگی در هیأت با تقدیم درخواست توسط صاحبان اسناد سجلی یا اشخاص ذی‌نفع یا مسئولین ثبت احوال به‌عمل می‌آید. هیأت‌ حل اختلاف به‌علت برخورداری از آیین‌نامه خاص رسیدگی تحت عنوان «آیین‌نامه طرز رسیدگی هیأت‌‌های‌ حل ‌اختلاف ثبت احوال» از حیث رعایت اصول دادرسی عادلانه از جایگاه مناسب‌تری نسبت به دیگر مراجع اختصاصی اداری برخوردار است. در این نوشتار به بررسی تشکیلات، صلاحیت ذاتی و محلی، اصول حاکم بر رسیدگی هیأت‌های حل اختلاف و آیین دادرسی آن خواهیم پرداخت. https://jcl.illrc.ac.ir/article_243178_26ef4df38541cda8919843b7d0255e8b.pdf
