This has led to disagreements and suggestions about changing the position of the Organization of Registration of Deeds and Real Estates in the structure of the government and the three powers, and raises the question of what factors cause that organization to be a separate or integral part of the judiciary, and what effect will this issue have on the independence of the judiciary as well as the performance of the Registration Organization? This study has reached the conclusion, using a descriptive - analytical method, focusing on the study of the duties of the Organization and matters of a judicial nature, that in the light of the nature of the various duties and powers of the departments of the Organization, the separation of enforceable official documents departments to the structure of the judiciary, separation of real estate registries as part of the legislature, Separation of notaries, marriage and divorce offices and registration of companies to the executive branch, and annexation of patents and industrial property to the Civil Registry Office, are in line with judicial independence and legal principles. در کشور ما سازمان ثبت اسناد و املاک، وابسته به قوه مستقل قضائیه است. این امر سبب اختلاف نظرها و پیشنهادهایی در خصوص تغییر جایگاه سازمان ثبت اسناد و املاک در ساختارحاکمیت و قوای سه گانه شده است و این پرسش را مطرح می‌سازد که چه عواملی سبب می‌شود تا سازمان ثبت اسناد و املاک کشور را بخش منفک یا لاینفکی از قوه قضائیه، محسوب بداریم واین امرچه تأثیری در استقلال دستگاه قضا و نیز عملکرد سازمان ثبت به جا خواهد گذاشت. این پژوهش با روش توصیفی- تحلیلی و با تمرکز بر مطالعه وظایف سازمان ثبت اسناد و املاک کشور و امور دارای ماهیت قضائی به این نتیجه دست یافته است که با توجه به ماهیت وظایف و اختیارات گوناگون تشکیلات درونی سازمان ثبت اسناد و املاک، انتزاع ادارات اجرای اسناد رسمی لازم‌الاجرا به ساختار قوه قضائیه، انتزاع ادارات ثبت املاک به عنوان قسمتی از قوه مقننه، انتزاع دفاتر اسناد رسمی، دفاتر ازدواج و طلاق و ثبت شرکت‌ها به قوه مجریه و الحاق ثبت اختراعات و مالکیت صنعتی به اداره ثبت احوال در راستای مصلحت استقلال قضائی و مبانی قانونی است. https://jcl.illrc.ac.ir/article_243269_f8317344fad9fbf32d99dc0b0d6b2643.pdf
