The existing literature in Iran and Syria on judicial oversight suffers from significant backwardness compared to Western countries and needs serious reforms in this area. The legislator's failure to provide guarantees for the implementation of judicial oversight of prosecution and investigation in the Iranian and Syrian Criminal Procedure Code has led to significant abuses. The findings of the research indicate the necessity of using a number of executive mechanisms in the judicial supervision of investigative and prosecution measures in order to achieve a suitable supervisory model in the criminal justice system of Iran and Syria. These guarantees include the need to increase monitoring mechanisms for visible crimes in comparison with invisible crimes, using new technologies to increase the accuracy of monitoring, applying performance guarantees for the violations of the monitoring and supervised institutions, holding continuous training courses and promoting the culture of monitoring, maintaining the independence of the institution. The trustee is responsible for researching the relationship between hierarchy and institutional control, continuity and continuity in supervision. نظارت قضایی عبارت است از اتخاذ نظارت از سوی قضات دادگاه یا قضات متخصص مستقل و خارج از نهاد دادسرا بر اقدامات و تصمیمات نهاد دادسرا از جمله بازپرس و به خصوص ناظر بر اقدامات محدود کننده حقوق و آزادی های افراد در مرحله پیش دادرسی کیفری است. دست‌یابی به الگوی مطلوب نظارت قضایی بر امر تعقیب و تحقیق، به صرف رعایت و پیش‌بینی اقتضائات و شرایط قانونی و قضایی محقق نمی‌گردد؛ بلکه علاوه بر این اقتضائات و شرایط اجرایی ضروری است. پژوهش حاضر به روش کیفی، ضمن بهره‌گیری از ابزار مصاحبه‌ عمیق و تحلیل اسناد و مدارک، صرفاً با تدقیق بر اقتضائات و شرایط اجرایی ضروری جهت ارتقای و تقویت نظارت قضایی بر اقدامات متولیان امر تعقیب و تحقیق موجود در ایران و سوریه، می‌پردازد. ادبیات موجود در ایران و سوریه درخصوص نظارت قضایی، در مقایسه با کشورهای غربی از عقب‌ماندگی قابل توجهی رنج می‌برد و نیاز به اصلاحات جدّی در این زمینه دارد. کوتاهی ‌قانون‌گذار در پیش‌بینی تضمین‌های اجرایی نظارت قضایی بر تعقیب و تحقیق در قانون آیین دادرسی کیفری ایران و سوریه موجب شده است که سوء‌استفاده‌های قابل توجهی صورت گیرد. یافته‌های پژوهش حاکی از ضرورت به کارگیری شماری از سازِکارهای اجرایی در نظارت قضایی بر اقدامات تحقیقی و تعقیبی در راستای رسیدن به الگوی نظارتی مناسب در نظام‌ دادرسی کیفری ایران و سوریه است. این تضمینات عبارتند از لزوم افزایش سازکارها نظارتی بر جرایم مشهود در مقایسه با جرایم غیر مشهود، بهره‌گیری از فناوری‌‌های نوین جهت افزایش دقت در نظارت، اعمال ضمانت‌اجرا در قبال تخلف نهاد ناظر و نظارت‌شونده، برگزاری دوره‌های آموزشی مستمر و ترویج فرهنگ نظارت‌پذیری، حفظ استقلال نهاد متولّی امر تحقیق از رابطة ‌‌سلسله‌مراتبی و سیطرة نهادی، تداوم و استمرار در نظارت است. . . . . . . . . . . . . . . . . . . . . . https://jcl.illrc.ac.ir/article_724552_224baad1f0f179d61b0286d9658af1d0.pdf
