		<Abstract>Legal entities, much like natural persons, are endowed with legal rights and obligations and play a significant role in social, economic, and cultural spheres. They are capable of sustaining harm, both financially and morally. While there is broad consensus regarding the recognition and compensation of financial and moral damages inflicted upon natural persons, the possibility of moral harm and its compensation for legal entities remains a contentious issue. This debate has sparked serious disagreement among legal scholars, judges, and practitioners.&lt;br /&gt;&lt;br /&gt;The core question revolves around whether, given the non-human and abstract nature of legal persons, injuries such as reputational damage, loss of credibility, or other non-material harms can be acknowledged and compensated. Some legal theories, relying on the fictional and constructed nature of legal personality, argue that moral damage in this context lacks a sound legal and logical foundation. They contend that since legal entities do not possess emotions or human dignity, they cannot suffer moral harm in the same way individuals do.&lt;br /&gt;&lt;br /&gt;On the other hand, opposing views emphasize the principle of legal equality between natural and legal persons. These perspectives invoke foundational legal doctrines such as the “La Zarar” principle (no harm), and point to the real-world consequences of reputational and credit-related damage in commercial and professional relationships. They argue that such harm can undermine a legal entity’s standing, trustworthiness, and economic viability, and therefore should be legally recognized and compensated.&lt;br /&gt;&lt;br /&gt;This article adopts an analytical-descriptive methodology to explore these divergent views and conducts a comparative legal study of France, Egypt, and Iran. It aims to demonstrate that moral damage to legal entities is not only conceptually valid but also legally actionable within the Iranian legal system. Moreover, certain legislative texts explicitly acknowledge the possibility of moral harm to legal persons, reinforcing the argument for its compensation. .</Abstract>
			<OtherAbstract Language="FA">اشخاص حقوقی همانند اشخاص حقیقی، از حقوق و تکالیف قانونی برخوردار بوده و به‌عنوان بازیگران مؤثر در عرصه‌های اجتماعی، اقتصادی و فرهنگی، قابلیت ورود ضرر را دارند. درباره جبران زیان‌های مالی و معنوی وارد بر اشخاص حقیقی، اتفاق نظر وجود دارد؛ اما در خصوص امکان ورود و جبران زیان معنوی نسبت به اشخاص حقوقی، اختلاف‌نظر جدی میان حقوق‌دانان، قضات و صاحب‌نظران مشاهده می‌شود. مسئله اساسی آن است که آیا بنا به ماهیت غیرانسانی شخص حقوقی، صدمات حیثیتی، اعتباری یا غیرمادی را می‌توان شناسایی و قابل جبران دانست یا خیر؟ برخی نظریات، با استناد به ماهیت فرضی و غیر واقعی شخصیت حقوقی، معتقدند که پذیرش زیان معنوی در این خصوص فاقد مبنای منطقی و حقوقی است. در مقابل، دیدگاه‌های دیگری با تأکید بر برابری حقوقی اشخاص حقوقی و حقیقی، استناد به قاعده «لاضرر»، و با تکیه بر شناسایی آثار زیان‌بار حیثیتی و اعتباری در روابط تجاری، از امکان جبران چنین خساراتی دفاع می‌کنند. افزون بر این، تجربه‌های حقوق تطبیقی نشان می‌دهد که حقوق فرانسه و مصر نیز، به‌ویژه در رویه قضایی و برخی مقررات خاص، امکان مطالبه زیان معنوی از سوی اشخاص حقوقی را در موارد معین پذیرفته‌اند. در این مقاله، با روش تحلیلی–توصیفی و رویکرد تطبیقی، ضمن بررسی مفاهیم، مبانی و مصادیق زیان معنوی، تلاش شده است تا با تحلیل رویه‌های قضایی موجود، مبانی فقهی و نظریات حقوقی معتبر، امکان جبران این نوع ضرر برای اشخاص حقوقی در نظام حقوقی ایران اثبات شود. یافته‌ها حاکی از آن است که شناسایی و جبران زیان معنوی وارد بر شخص حقوقی، نه‌تنها با اصول عمومی حقوق مدنی و قواعد عدالت تعارضی ندارد، بلکه با تکیه بر مبانی عقلی و نظریه‌های نوین، قابلیت تنظیم در قالب مقررات قانونی مستقل یا ضمن مواد قانونی موجود را داراست.&lt;br /&gt;&lt;br /&gt;کلیدواژه: زیان معنوی؛ خسارت معنوی شخص حقوقی؛ شخص حقوقی و زیان معنوی . . . . . .</OtherAbstract>
