<ArticleTitle>Foundations of Criminalization of National Flag and Anthem Desecration and Its Conflict with the Right to Freedom of Expression (A Comparative Study of Criminal Policy in Eight Countries)</ArticleTitle>

		<Abstract>The national flag and anthem, as official symbols of national identity, are protected under criminal law in many countries, and the criminalization of their desecration is often justified as a means to preserve national identity and safeguard state security. These measures aim to prevent actions that may undermine the authority, legitimacy, or dignity of the state. However, criminalizing desecration can conflict with the fundamental right to freedom of expression, which is guaranteed under international human rights instruments. Human rights analyses suggest that national unity cannot be effectively maintained through coercive legal interventions alone, and mandatory respect for national symbols risks restricting individual freedoms. Excessively strict criminal policies may lead to human rights violations, limiting citizens’ capacity to engage in political discourse, symbolic protest, or social criticism. Comparative studies show that countries such as the United States, Canada, and the United Kingdom generally do not criminalize insults to national symbols, protecting such acts under freedom of expression unless they involve direct threats, violence, or public disorder. Conversely, in countries including Germany, France, China, and Iran, desecration of national symbols is criminalized; in Iran, similar acts may be prosecuted under broad provisions concerning crimes against national security, reflecting an ambiguous and expansive criminal policy. Based on a descriptive-analytical approach, this article examines the foundations of criminalizing insults to the flag and anthem, its conflict with freedom of expression, and the approaches adopted in eight selected countries. The study concludes that criminalizing desecration per se conflicts with freedom of expression and the principle of minimal criminal law. Such criminalization is only justified when actions genuinely threaten public order or national security. Therefore, a proportionate, human-rights-based criminal policy should respect national symbols while ensuring that fundamental human rights and freedom of expression are fully protected, maintaining a balance between symbolic national protection and individual liberties.</Abstract>
			<OtherAbstract Language="FA">پرچم و سرود ملی به‌عنوان نمادهای رسمی هویت ملی در بسیاری کشورها مورد حمایت قوانین کیفری قرار دارند و جرم‌انگاری هتک حرمت آن‌ها با هدف حفظ هویت ملی و امنیت کشور توجیه می‌شود. با این حال، چنین جرم‌انگاری می‌تواند با حق بنیادین آزادی بیان، که در اسناد بین‌المللی حقوق بشر تضمین شده، تعارض داشته باشد. تحلیل حقوق بشری موضوع نشان می‌دهد حفظ وحدت ملی با مداخله کیفری و تحمیل احترام اجباری محقق نمی‌شود و حفاظت از نمادهای ملی نباید آزادی‌های فردی، به‌ویژه حق آزادی بیان، را محدود کند. از این رو، سیاست کیفری سخت گیرانه و سرکوب گرانه در این زمینه ممکن است منجر به نقض حقوق بشر شود. بررسی تطبیقی نظام های حقوقی کشورهای مختلف نشان می‌دهد که در برخی کشورها مانند آمریکا، کانادا و انگلستان، توهین به نمادهای ملی جرم نیست و تحت حمایت آزادی بیان قرار دارد، اما در بسیاری کشورها این نوع توهین جرم‌انگاری و کیفرگذاری گردیده و در ایران با وجود خلا قانونی در این زمینه، ممکن است تحت عناوین جرایم علیه امنیت تحت تعقیب قرار گیرد که نشانگر یک سیاست جنایی مبهم و فراگیر است. بر این اساس، مقاله حاضر به روش توصیفی-تحلیلی با تمرکز بر مبانی جرم‌انگاری توهین به پرچم و سرود ملی و بررسی تعارض این مساله با حق آزادی بیان، ضمن بررسی تطبیقی رویکرد هشت کشور مختلف از جمله ایران، نتیجه می‌گیرد که جرم انگاری بی‌حرمتی به سرود ملی و پرچم فی نفسه با حق آزادی بیان و اصل حداقل بودن حقوق کیفری مغایرت دارد و جرم انگاری چنین رفتاری در صورتی موجه است که سبب اخلال در نظم عمومی یا به خطر افتادن امنیت ملی شود. بنابراین، سیاست جنایی متناسب و حقوق بشری در این زمینه باید به گونه ای تدوین شود که هم نمادهای ملی را محترم بشمارد و هم حقوق بنیادین بشر و آزادی بیان را تضمین نماید.</OtherAbstract>
