Abstract
In today's world, the extensiveness of scientific discussions and the interdisciplinary nature of many topics make collaboration between researchers essential.
In response to this necessity, research teams are rapidly expanding on an international level.
These types of teams, due to their inherent complexities and interactions among team members, require specific ethical and legal frameworks.
Although it is the responsibility of each team member to pay attention to effective ethical considerations in team research, relying on this is not sufficient in all cases;
Compliance with ethics without taking on a legal aspect cannot, by itself and mere relying on the conscience of team members, guarantee the sustainability and success of the research team.
It is better to go beyond mere ethics and include ethical considerations from a legal perspective as a contractual obligation in team functional agreements.
That is, it is necessary to conclude an ethical agreement between team members in which the legal aspects of observing ethical principles are taken into account and appropriate legal guarantees are determined for them;
This is something that is especially important in large research teams, particularly the international ones, but is often overlooked in our country.
In addition to preventing many future disputes between team members, this measure assures researchers that there is transparency and, consequently increases the desire and motivation to form a research team.
In fact, "team research ethics agreements" are considered key devices for facilitating sustainable and effective collaboration and improving the quality of research.
This study proposes preventive and remidial legal solutions to common ethical conflicts in team research by formulating ethical rules for in compliance with legal regulations in team research agreements.
According to the research results, these agreements should include various dimensions in terms of will, capacity (with three criteria of ethical conflicts, competence and learning), subject matter, legitimate motivation, and methods of conflict resolution and legal enforcement guarantees for breach of obligations.
