Synergy of Intent and Recklessness in Forming a Novel Category of Murder: A Comparative Study under the Islamic Penal Code and the U.S. Criminal Justice System

Abstract
This study examines and analyzes the legal dimensions of the criminal judgments issued in Case No. 9209982103501067 (homicide resulting from intentional arson) and seeks to demonstrate how, in such conduct, the “synergy of intent and recklessness” may give rise to a novel category of intentional homicide. Based on the procedural background outlined in the introduction and relying on the criteria of the Islamic Penal Code, the analysis first addresses the absence of a direct intent to kill. Nevertheless, despite the lack of intent to kill (or intent to hit a specific target), the defendant’s conduct involved the creation of an extreme and gross risk to human life—one exceeding the threshold contemplated in the opening clause of paragraph (p) of Article 291. Consequently, the conduct falls within the regulatory scope concerning “creation of gross risk” and the requirement to establish “awareness and appreciation of severe danger.” Accordingly, although the conduct in question does not fall within the four subcategories of Article 290 of the 2013 Islamic Penal Code, it may—given the criterion set forth in the Note to Article 292 (requiring proof of awareness of severe danger)—be aligned with a form of intentional homicide that appears to be realized in this case. In the U.S. criminal justice system, by establishing two analogous elements—(extreme recklessness and awareness of risk)—the act under consideration is classified as “depraved heart murder” or “extreme recklessness murder,” which is categorized as second degree murder and is punishable by life imprisonment. Finally, considering the statutory and jurisprudential foundations governing the attribution of “intent” in Iranian law—and taking into account the distinct level of blameworthiness associated with this type of conduct compared to other forms of intentional homicide—it appears that reliance solely on qisās may not correspond proportionately to the actual gravity of the conduct. This suggests that legislative reform could help determine a more proportionate punishment for this model of “synergy between intent and recklessness.”
