Dealing with disputes arising from commercial transactions, conducted on a daily and intermittent basis, requires expedited proceedings that are hardly compatible with the general rules of civil procedure. Part of the economic life of society depends on the outcome of these lawsuits; For this reason, it is appropriate to entrust determination of entitlement in such claims to person or persons who have been duly selected and are familiar with the ins and outs of commercial affairs. Judges serving in public courts do not have the opportunity, and perhaps the motivation, to master the voluminous laws and emerging customs in this field. Various laws and bills have mentioned establishment of a specialized institution to deal with commercial disputes, and each more or less addresses the qualifications of the judges who will be appointed to adjudicate such claims. The findings of this study indicate that the current practice prevalent in France, in which proceedings are conducted by at least three judges selected from among businessmen and not professional judges, has been almost abandoned by the rest of the world. On this basis, the existence of professional judges and students with legal degrees in Iran continues to be acknowledged. Judgment rendered by a panel of judges or a single judge is also another aspect that has been raised; in this regard, however, it is likely that by resorting to the method of employing a number of judges, issuance of judgments with greater accuracy will increase. However, considering the inherent limitations and complexities of proceedings conducted by a panel of judges and the need for coordination between them, indicates that multiplicity of judges would be in conflict with the philosophy of separating the trial of commercial claims from the jurisdiction of public courts and the need to observe the speed principle in dealing with these claims. And in short, the best way, right now, is to trust and refer these cases to an expert and experienced judge in this field, and simply increasing the number of judges will not solve a problem.
