Today, preservation of agricultural land and prevention of its fragmentation has become one of the priorities and challenges faced by all governments around the world, due to its important role in food security and other social, economic, and even political issues, and has also been recommended and emphasized by international organizations. One of the institutions that has been used in various countries to preserve agricultural lands and prevent fragmentation, as well as develop their integrity, is the "right of priority" to purchase agricultural land granted to a specific group of beneficiaries. This research uses the descriptive and analytical method to study how the European Union member states have used the right of priority to preserve agricultural land and what criteria and procedures they have adopted for its implementation. In the following, considering the institution of priority right and its function, the haghe shofeh (i.e if immovable property is divisible between two partners and one of the partners transfers his share to a third party with the intention of selling it, the other partner has the right to give him the price paid by the buyer and take possession of the sold share) in Iranian jurisprudence and law will be briefly discussed, and the developmental and extensible perspectives that are close to the right of priority in European law will be mentioned, and finally, proposed articles for codification of the "right of priority in agricultural lands" will be presented.
